Welcome to Tryva AI. By accessing or using our website (tryva.ai), Shopify application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service.

1. Acceptance of Terms

By creating an account, installing our Shopify app, or using any part of our Service, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use our Service.

2. Description of Service

Tryva AI provides AI-powered virtual try-on technology, AI model photography generation, and product photography services for e-commerce businesses. Our services include:

• Virtual try-on: AI-powered garment visualization on user-uploaded photos
• AI Studio: Professional model photography generation
• Product Studio: AI-enhanced product photography
• Shopify Integration: Embeddable widget and product management

3. Account Registration

To use our Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current, and complete information.

4. Subscription Plans & Credits

• Free Trial: New accounts receive free credits to explore our features.
• Paid Plans: Starter, Growth, and Professional plans with monthly credit allocations.
• Credits: Each AI generation consumes credits. Unused credits do not roll over to the next billing period.
• Billing: Paid subscriptions are billed monthly through Stripe or Shopify Billing. You may cancel at any time.
• Refunds: Subscription fees are non-refundable except as required by applicable law.

5. Acceptable Use

You agree not to:

• Upload illegal, harmful, or inappropriate content
• Use the Service to generate deceptive or misleading content
• Attempt to reverse-engineer, copy, or redistribute our AI technology
• Exceed rate limits or abuse the API
• Use the Service for any purpose that violates applicable laws
• Upload images of minors or non-consenting individuals

6. Intellectual Property

Your Content: You retain ownership of images you upload. By uploading images, you grant us a limited, non-exclusive license to process them through our AI engine solely to provide the Service.

Generated Content: AI-generated images created through our Service are yours to use for commercial purposes, including product listings and marketing materials.

Our Service: Tryva AI, its branding, technology, and code are our intellectual property and are protected by copyright and trademark laws.

7. AI-Generated Content Disclaimer

Our AI technology generates images based on your inputs. While we strive for accuracy, AI-generated content may not always perfectly represent products. You are responsible for reviewing generated content before publishing it to your store or using it commercially.

8. Shopify App Terms

When using our Shopify app, you additionally agree to Shopify's Terms of Service and API Terms. We access your store data only within the scope of permissions you grant during installation.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your data.

10. Limitation of Liability

To the maximum extent permitted by law, Tryva AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service interruptions.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may cancel your account at any time. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ankara, Turkey.
